First I will tell you that on June 16, 2009, the Breach I filed September 11, 2008 was Dismissed with Prejudice by the assigned judge from Perry County. No reason why, no explanation.
On June 24, 2009, there was another trial brought by my opponent, Fred Snyder and his attorney James A Kelly. Snyder's attorney filed for Summary Judgment again as they did 5 years ago. The note I hold on Snyder's NJ property was to ensure me reimbursement for one-half the down payment of the Springfield home. Although the original trial Judge (George Pagano) took away my note on Snyder's NJ property in 2003, you may recall that when I appealed, I prevailed in Superior Court in 2004 and still held my note.
Now, at this June 24th trial, and when it was my turn to speak, another judge (Judge Proud), seemed to be getting it. He was nodding his head as I addressed the inaccuracies in Kelly's Proposed Findings of Fact and Conclusions of Law. Of course, I expected the original document from the original trial in 1999 to be presented to the judge, but in fact Kelly prepared a different one and when it was my turn to speak, threw it my way.
I was commended on my pretrial statement and the points I addressed and really thought this time I have a decent judge who understood what happened back in 1999 when Judge Pagano erred in his decision.
NOPE....THE GOOD OLD BOYS STUCK TOGETHER ONCE AGAIN!
Judge Proud has just made my life worse with a JULY 1, 2009 Order.
Not only does he NOT order my opponent to sign a quitclaim deed off my Springfield home, but he orders me satisfy the note on the NJ property when if fact Snyder NEVER repaid me. Recording that Snyder has repaid me is lying and alleviating him of any obligation to repay me. The order also reads that the escrowed funds of will be released to Snyder! This order is in addition to Judge Pagano's May 2001 Order for me to remove Snyder from any mortgage obligation but does not order Snyder to sign off my Springfield deed!
Is it me or does anyone else smell something really bad here?
